Terms of service

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you and The Vikalp (“we”, “us”), an independent software companybased in Rajasthan, India, which operates the Refine service. By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the service. More about the company at thevikalp.com.

2. Your account

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Refine. You're responsible for safeguarding your password and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

3. Acceptable use

You agree not to:

• Upload content that is illegal, infringing, or that you don't have the right to share.
• Use Refine to harass, threaten, or harm others, or to facilitate the non-consensual distribution of intimate imagery.
• Attempt to reverse-engineer, decompile, or extract source code from the service (except as permitted by applicable open-source licences).
• Circumvent rate limits, attempt to access other users' data, or probe the service for vulnerabilities without coordination.
• Use the service to train AI models or create datasets from other users' content.

4. Your content

You retain all rights to the content you upload. You grant The Vikalp a limited, worldwide, non-exclusive licence to host, store, process, transmit, and display your content solely for the purpose of operating the service for you. This licence terminates when you delete the content or your account.

We don't claim ownership of your content. We don't sell it. We don't train AI on it. We don't use it for advertising (we don't have any).

5. Subscriptions & billing

Paid plans are billed in advance on a recurring monthly or annual basis. By starting a paid plan, you authorise us to charge your payment method on each renewal until you cancel. Prices are shown and charged in the currency displayed at checkout.

Payments are collected by our payment gateway partner, a PCI-DSS compliant processor. Your full card number, UPI PIN, and CVV are entered on their systems and are never stored by us - we keep only a payment token and the card brand and last four digits so you can identify the method on file. Recurring charges are taken under an auto-debit mandate (for example a UPI AutoPay mandate or a card recurring mandate) that you authorise at checkout; you can cancel the mandate at any time from your bank, UPI app, or your Refine billing settings.

• Upgrades take effect immediately and are pro-rated.
• Downgrades take effect at the end of the current billing period. Your data is never deleted as a result of a downgrade.
• Refunds - full refund within 14 days of any paid charge. After 14 days, fees are non-refundable except where required by law.
• Taxes - prices exclude applicable taxes unless stated otherwise, and any tax due (including GST on Indian customers) is added at checkout. You're responsible for any taxes in your jurisdiction.
• Price changes - we'll give you at least 30 days' notice before any price increase.

6. Termination

You can delete your account at any time from Settings - Account. We may suspend or terminate accounts that violate these Terms, with notice where practical. On termination, your data is purged as described in our Privacy Policy.

7. Intellectual property

The Refine service, including its UI, code, trademarks, and documentation, is owned by The Vikalp or its licensors. You're granted a limited, non-exclusive, non-transferable right to use the service for personal or internal business purposes, subject to these Terms.

8. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, The Vikalp's aggregate liability for any claim arising out of or related to the service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $100, whichever is greater. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

You agree to indemnify and hold The Vikalp harmless from any claim arising out of your breach of these Terms, your content, or your unlawful use of the service.

11. Changes to these terms

We may update these Terms from time to time. If a change is material, we'll give you at least 30 days' notice by email and a banner in the app. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the courts at Kotputli-Behror / Jaipur, Rajasthan, India.
